Kentucky Car Insurance Coverage and Rates

– Kentucky Minimum Coverage

All states require a minimum amount of driver liability coverage. This coverage ensures that, should a driver get into an accident while on the road, they won’t have to immediately dive into their savings to pay for the damage done.

Kentucky’s minimum liability requirements include:

  • $25,000 for injuries per person in a single accident that you caused
  • $50,000 total for all injuries resulting from a single accident you caused
  • $10,000 for property damage resulting from an accident that you caused

It’s worth noting here that Kentucky is, technically, a no-fault state. That “technically” has nothing to do with the state’s position as a commonwealth. Rather, Kentucky residents can opt out of no-fault car insurance, making the state a “choice no-fault” state rather than a standard “no-fault” one.

In Kentucky, no-fault insurance takes the form of Personal Injury Protection, or PIP. This protection allows drivers up to $10,000 of coverage meant to pay off medical bills or property damage costs immediately upon the occurrence of an accident.

– Forms of Financial Responsibility

While driving in Kentucky, you need to have a form of financial responsibility – otherwise known as proof of insurance – on your person or in your car whenever you’re on the road. Different acceptable forms of financial responsibility include:

  • A valid liability insurance ID card
  • A copy of your current car insurance policy
  • A valid insurance binder or another form of temporary car insurance
  • Car insurance documents presented via cellphone or laptop, so long as they aren’t expired

If you’re not able to show a police officer a form of financial responsibility upon being pulled over, you may face any of the following four consequences:

  • Fines – first offenses can run up a charge of between $500 and $1,000, with the following offenses costing drivers more.
  • Jail Time – first offenses can result in 90 days of jail time combined with the aforementioned fines. If you’re caught without proof of insurance again, you could spend up to 180 days in jail.
  • Loss of Driving Privileges – if you drive without proof of insurance, the state can suspend your license for up to a year. While a second offense results in the same consequence, a third offense can see your license revoked for two years or more.
  • Forced Reassessment – if your license is suspended, you’ll have to take the necessary steps to have it reinstated. This includes a $40 fee and proof of a new insurance policy. If your license is suspended for a year or more, then you’ll need to re-pass your driver’s exam to legally return to the road.

  • Kentucky drivers may choose their own repair vendors, but they will have to pay the difference if their chosen vendor charges a rate higher than the one their provider anticipated.

– High-Risk Insurance

If you have a spotty driving history, you may have to seek out high-risk insurance. High-risk insurance, or an SR-22, is a type of insurance that high-risk drivers are required to add to their existing coverage after a conviction or similar punishment.

You may be required to get an SR-22 if you’ve received any of the following:

  • DUI conviction
  • Reprimand for driving without insurance
  • Reprimand for driving with a suspended license
  • Reprimand for leaving the scene of an accident

That all said, Kentucky doesn’t have legislation in place that requires its high-risk drivers to obtain SR-22 coverage. Instead, the state relies on a mandatory insurance requirement. This high-risk insurance plan also goes by the Kentucky Automobile Insurance Plan. While applicants can’t choose the provider they’re paired with, working with the plan gives high-risk drivers access to:

  • A valid Kentucky driver’s license
  • State minimum liability coverage

– Low-Cost Insurance

Kentucky also does not offer car insurance programs for low-income families that would ease the pressure of paying for car insurance. However, drivers can seek out discounts to make the cost of insurance more bearable.

– Automobile Fraud in Kentucky

It’s difficult to commit insurance fraud by accident.

That said, the insurance industry sees 10 percent of its operating costs go to enduring fraudulent claims or accounts over the course of a year.

There are two different types of automobile fraud.

  • Hard fraud sees a driver deliberately falsifying a claim or faking an accident in order to receive compensation

– Statute of Limitations

A statute of limitations outlines the amount of time a driver has after an accident has taken place to file a compatible claim. Drivers in Kentucky must work within the following time blocks:

You’ll need to ensure that you have a form of financial responsibility on your person or in your car should you happen to get pulled over by a police officer. Remember, the different valid forms of financial responsibility include:

  • A valid insurance binder or another form of temporary car insurance
  • Car insurance documents presented via cellphone or laptop, so long as they aren’t expired

– Teen Driver Laws

It can be scary to teach your child to drive for the first time. The good news is that if you live in Kentucky, you have until your child turns 16 to figure out whose car you want to sacrifice for educational purposes.

There are three different license variations your teen driver can get. These break down into a permit, an intermediate license, and an unrestricted license. Take a look at the variations between these licenses below:

– License Renewal Procedures

In Kentucky, drivers old and young go through the same procedure to renew their licenses. Drivers need to renew their licenses on an eight-year rotational period.

Drivers aren’t required to have their vision tested, and they must go to a physical DMV to complete the renewal. As of this point, Kentucky does not allow its drivers to renew their licenses through the mail or through an online medium.

– Licensing for New Residents

When you move to Kentucky for the first time, you’ll need to ensure that your minimum liability insurance matches up with the state’s requirements. Kentucky Law requires new residents to apply for new vehicular registration within 15 days of moving to their new county.

– Rules of the Road

– Fault vs. No-Fault

Kentucky is a no-fault state. This means that if you happen to get in an accident while driving through Kentucky, you only have to pay for the damage done to your own car.

In other words, the other driver, if they are the perpetrator of the accident, won’t pay for your damages.

When driving through a no-fault state, you’ll definitely want to consider investing in more than just your state’s minimum liability policy. Car accidents can get expensive, and without someone else’s budget to buffer your bank account, you’ll want to protect your savings.

– Seat Belt and Car Seat Laws

Kentucky promotes strict seat belt and car seat safety to prevent injury and death among child passengers in its drivers’ cars. This concern comes on the heels of statistics revealing that vehicular accidents are the leading cause of child fatalities.

If you’re caught violating these standards, you’ll be charged a $25 fine with additional fees pending.

Also note that there are no laws in Kentucky forbidding or punishing passengers for riding in the cargo area of a pickup truck.

– Keep Right and Move Over Laws

As of June 2007, the state of Kentucky made it illegal for drivers to hang in the left lane of two or more lane roads unless they were passing or turning left. This new law complies with the state’s longstanding “keep right” policy, which encourages slower drivers to remain on the right side of all highways.

Similarly, Kentucky state law requires that all vehicles move to the right side of the road when approached by an emergency vehicle that has its lights on. These vehicles include but are not limited to:

  • Ambulences

In Kentucky, four companies currently offer ridesharing insurance policies:

  • Allstate
  • Erie Insurance
  • State Farm
  • USAA

While your employer may direct you towards a car insurance partner, know that you absolutely need to have ridesharing insurance to legally ferry passengers across Kentucky in your vehicle.

– Automation on the Road

At this point in time, with automated vehicles still in development, Kentucky has not instated any laws regarding self-driving cars.

If that’s not enough, know that getting caught driving while intoxicated can have a significant impact on the rate that your car insurance provider is able to offer you. For the sake of your wallet, then, if not the other drivers around you, call a rideshare if you’ve been drinking, and do not get behind the wheel of a car while drunk.

– Distracted Driving Laws

Taking your eyes off the road to answer a text may not feel like a significant breech in roadway safety. Even so, that kind of distraction can still result in an accident.

At this point in time, Kentucky has not instated a hand-held device ban.

However, no driver under the age of 18 is allowed to be on their cellphone while driving a vehicle. Likewise, no driver, regardless of age, is legally allowed to text while at the wheel of a car.

Some roads are naturally more dangerous than others. Sometimes this is due to their make, and other times it’s due to the areas they pass through. US Route 62 in Kentucky connects to Mexico and Canada and sees over 11 fatal accidents over the course of a year, more than any other highway in the state.
